These Terms of Use, together with any policies, rules, and documents incorporated by reference (collectively, "Terms"), constitute a legally binding agreement between you and REPOSÉ PILATES Inc. ("REPOSÉ CLUB," "we," "us," or "our"). They govern your use of our website at clubrepose.com (the "Site") and all content, information, products, and services available through it (the "Services").
By accessing or using the Site or Services, you accept and agree to be bound by these Terms, along with any additional terms incorporated by reference including membership agreements, liability waivers, and studio-specific policies. If you do not agree, do not use the Site or Services.
You must be at least 18 years of age to independently enter into these Terms. Where a member is under 18, a parent or legal guardian must sign the membership agreement and liability waiver on their behalf and is jointly responsible for all fees and obligations arising under these Terms.
We may amend these Terms at any time. Material changes will be communicated by email or posted on the Site with at least 14 days' notice before taking effect. If you do not accept a material change, you may cancel your membership or discontinue use of the Services before the change takes effect and will not be penalized for doing so. Continued use of the Site or Services after a change takes effect constitutes acceptance of the revised Terms.
Your privacy matters to us. Our Privacy Policy governs how we collect, use, and protect your personal information in connection with the Site and Services, and is incorporated into these Terms by reference. By using the Site or Services, you acknowledge and agree to the Privacy Policy. Our practices comply with the Personal Information Protection Act (Alberta) and applicable Canadian privacy legislation.
We are committed to making the Site and Services accessible to everyone. If you experience difficulty accessing any part of the Site or have feedback on accessibility, please contact us at hello@clubrepose.com and we will do our best to assist you.
By providing your mobile number or email address, you consent to receive electronic communications from us, including service-related messages and, where you have opted in, marketing communications. Express consent to marketing communications is obtained at the time of registration or subscription sign-up and is recorded with a timestamp and the method by which consent was given, in accordance with Canada's Anti-Spam Legislation (CASL). You may withdraw consent to marketing communications at any time by following the unsubscribe instructions in any such message or by contacting us directly. Withdrawal of consent to marketing communications does not affect delivery of transactional or service-related messages.
You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at hello@clubrepose.com if you suspect unauthorized access. We reserve the right to suspend accounts that violate these Terms.
Membership offerings, including pricing and inclusions, are described on the Site and disclosed to you at the point of purchase before any payment is processed. All memberships are subject to these Terms and any applicable membership agreement. Membership fees are billed in advance on a recurring monthly basis (or such other interval as stated at the time of purchase) beginning on the date your first payment is processed.
Automatic renewal. Monthly memberships renew automatically each month unless cancelled. At the start of each billing period, the applicable fee will be charged to your payment method on file. Class passes and other non-monthly purchases do not auto-renew.
Cancellation. You may cancel your membership at any time by visiting your account page, emailing us at hello@clubrepose.com, or following the cancellation process outlined in your membership agreement. Cancellations take effect at the end of the then-current billing period. No refunds are issued for any unused portion of a current membership period.
Founding membership rate lock. If you hold a Founding Membership, your rate is guaranteed permanently as described in your Founding Membership agreement, provided your membership remains active and in good standing and you have not voluntarily cancelled or allowed your membership to lapse. This rate guarantee is personal to you and does not transfer. REPOSÉ CLUB is unconditionally committed to honouring this rate for the lifetime of your membership, regardless of any future pricing changes.
Failed payments. If your payment cannot be processed, you remain responsible for the outstanding amount. We may attempt to reprocess the charge and reserve the right to suspend or terminate your membership for non-payment.
Price changes. We will give you reasonable advance notice of any price changes. If you do not wish to continue under the new pricing, you may cancel before the change takes effect.
Membership pause. Active members may request to pause their membership for a minimum of two weeks at a time, up to a combined maximum of three months (92 days) in any rolling 12-month period. Pauses may be taken in more than one block provided the total does not exceed the annual maximum. A minimum of two weeks' written notice is required. Pause requests can be submitted by emailing hello@clubrepose.com. No membership fees are charged during an approved pause period. Pauses cannot be applied retroactively.
Non-transferable. Memberships are personal and non-transferable. They may not be shared, assigned, or passed to another individual under any circumstances.
Advance notice required: A minimum of 24 hours' notice is required to cancel or reschedule any class, session, or appointment — including group classes, semi-privates, and private sessions.
Late cancellation. Any cancellation or reschedule made within 24 hours of the scheduled start time is a late cancellation. One session will be deducted from your applicable class or session pass, or a $25 CAD late cancellation fee will be charged if you hold an unlimited membership.
No-show. Failure to attend a reserved class or session without prior notice constitutes a no-show. A $25 CAD no-show fee will be charged. We enforce this policy consistently; exceptions may be considered only in documented extraordinary circumstances at our sole discretion.
Authorization. By booking any class or session, you authorize us to charge applicable fees to your payment method on file or deduct sessions from your pass. If you believe a charge has been made in error, please contact us at hello@clubrepose.com and we will work to resolve it promptly. Nothing in these Terms limits any rights you may have under your payment card agreement or applicable consumer protection legislation.
When a class is fully booked, you may join the waitlist. If a spot becomes available, all waitlisted clients are notified simultaneously — the first to confirm secures the spot. A notification is not a confirmation; your place is only guaranteed once you receive a booking confirmation.
Cancellation policy applies. Once confirmed from the waitlist, your booking carries the same obligations as any other reservation. The standard 24-hour cancellation window applies from the moment your spot is confirmed. Late cancellation and no-show fees apply in full.
Late notifications. If you receive a waitlist notification within 24 hours of class, you will not be penalized for declining the spot. However, if you confirm and subsequently do not attend, the standard no-show fee applies.
First visit. Please arrive 15 minutes early for your first class to complete your liability waiver and receive an equipment overview. If you anticipate being late for your first visit, please contact us in advance at hello@clubrepose.com — we may not be able to accommodate a first-time arrival who has not completed the waiver and orientation.
Returning members. Your reserved reformer is held for you regardless of arrival time. No late fee applies. Please enter quietly and follow the class already in motion.
Grip socks. Grip socks are required for all classes — they are a hygiene and safety standard for reformer Pilates. If you do not have a pair, we have them available for purchase at the studio. All grip sock sales are final.
Health disclosure. We ask that you inform your instructor of any injuries, physical conditions, surgeries, or pregnancies before class. This is not a barrier to participation; it simply allows our team to support you safely. You are responsible for ensuring that participation in reformer Pilates is appropriate for your current state of health.
General etiquette. REPOSÉ CLUB is designed to be a calm, focused environment. We ask that all members arrive prepared, silence their phones before entering the studio, and treat the equipment and shared space with care.
Right to refuse service. REPOSÉ CLUB reserves the right to decline, suspend, or discontinue a membership or booking where a member's conduct disrupts the studio environment or affects the comfort or safety of others. We would always prefer to resolve concerns through conversation first.
Founding Members and Unlimited Members each receive one complimentary guest pass per calendar month. Guest passes are valid for group classes only and cannot be applied to private or semi-private sessions. Passes do not carry over — unused passes expire at the end of each calendar month and have no cash value.
All guests must complete the REPOSÉ CLUB Liability Waiver before participating. The referring member is responsible for ensuring their guest is aware of studio requirements in advance.
These Terms are separate from the REPOSÉ CLUB Liability Waiver, which is a condition of participation and must be completed before your first class. You will be prompted to complete it digitally at the time of your first booking. Participation is not permitted without a completed waiver on file. The Liability Waiver is incorporated into and forms part of the overall agreement between you and REPOSÉ CLUB, together with these Terms, the Privacy Policy, and any applicable membership agreement. In the event of any conflict between the Liability Waiver and these Terms regarding physical injury or participation risks, the Liability Waiver governs. The Site and Services are for your personal, non-commercial use only. You may not reproduce, copy, sell, or commercially exploit any portion of the Site or Services without our express written consent.
You may not use the Site to transmit unlawful, abusive, defamatory, or otherwise objectionable content; upload content that infringes the rights of others; or send unsolicited commercial communications.
All content on the Site and Services — including text, images, graphics, logos, video, and software — is owned by REPOSÉ CLUB or its licensors and protected under applicable Canadian intellectual property laws. You may not reproduce, modify, distribute, or commercially exploit any content from the Site without our express written permission.
By submitting any content to us — including photos, social media tags, or reviews ("User Content") — you grant REPOSÉ CLUB a royalty-free, non-exclusive licence to use, reproduce, adapt, publish, and display that content in connection with operating the Site and promoting REPOSÉ CLUB's services in Canada and internationally. This licence continues for so long as reasonably necessary for the stated purposes and may be terminated by written request where continued use is no longer required for those purposes. User Content must not be unlawful, abusive, defamatory, or otherwise inappropriate. We reserve the right to remove any User Content at our discretion.
The Site may contain links to third-party websites or services. These links are provided for convenience only. We do not control, endorse, or accept responsibility for the content, privacy practices, or terms of any third-party site. Your use of third-party sites is at your own risk.
All prices are in Canadian dollars and subject to applicable taxes. In the event of a pricing or billing error, please contact us at hello@clubrepose.com and we will make it right. Payment processing is handled by a third-party provider.
Promotional offers and discount codes are limited to one use per customer unless otherwise stated. Discounts apply at checkout and have no cash value. They cannot be combined with other offers or applied to previous purchases.
We do not guarantee that the Site or Services will be available at all times. We reserve the right to modify, suspend, or discontinue any part of the Site or Services at any time, with or without notice, and will not be liable for any resulting disruption.
Any information provided through the Site is for general purposes only and does not constitute medical advice. Consult a qualified healthcare professional before beginning any exercise programme. Participation in Pilates and all related activities is at your own risk.
The Site and Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Alberta and Canadian law, REPOSÉ CLUB disclaims all warranties, express or implied, and does not warrant that the Site will be uninterrupted or error-free.
To the fullest extent permitted by applicable law, REPOSÉ CLUB and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of, or inability to use, the Site or Services.
Our total aggregate liability to you for any and all claims arising under these Terms will not exceed the total amount paid by you to REPOSÉ CLUB in the 90 days immediately preceding the event giving rise to the claim. For greater certainty, this limitation applies to claims relating to use of the Site and digital Services. Claims arising from physical injury or harm sustained during in-person participation are governed primarily by the REPOSÉ CLUB Liability Waiver (Section 14), and nothing in this Section is intended to expand or restrict the scope of that document.
Nothing in these Terms limits or excludes liability that cannot be excluded under the Consumer Protection Act (Alberta) or other applicable mandatory legislation.
You agree to indemnify, defend, and hold harmless the REPOSÉ CLUB Parties from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from: (i) your violation of these Terms; (ii) your use of the Site or Services; (iii) any User Content you submit; or (iv) your violation of any applicable law or the rights of any third party.

Governing law. These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Arbitration. Subject to the exceptions below, any dispute arising from your use of the Site or Services that cannot be resolved informally shall be submitted to binding arbitration in Calgary, Alberta under the Arbitration Act (Alberta) and the Arbitration Rules of the ADR Institute of Canada. The arbitration shall be conducted before a single arbitrator with relevant expertise. The arbitrator's award shall be final and binding.
Exceptions. Either party may seek injunctive or other equitable relief from a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm pending arbitration. In addition, either party may elect to bring any claim with a total value of less than $5,000 CAD in the Alberta Court of Justice (Small Claims) rather than through arbitration. Nothing in this Section prevents you from filing a complaint with the Alberta Consumer Protection Branch or another applicable regulatory body.
Limitation period. Any claim must be commenced within two (2) years of the date on which the cause of action arose, consistent with Alberta's Limitations Act.
If you believe that content on the Site infringes your copyright, please send a written notice to hello@clubrepose.com that includes: (i) a description of the copyrighted work; (ii) identification of the infringing material and its location on the Site; (iii) your contact information; (iv) a statement of good faith belief that the use is unauthorized; and (v) a declaration that the information provided is accurate.
Entire agreement. These Terms, together with our Privacy Policy and any applicable Additional Terms, constitute the entire agreement between you and REPOSÉ CLUB regarding the Site and Services.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
Assignment. We may assign our rights and obligations under these Terms at any time. You may not assign your rights under these Terms without our prior written consent.
